Federal Court Orders Release of Abrego Garcia from Immigration Custody
A federal judge has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement is without lawful basis.
"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her ruling.
The case originates in a mistaken deportation to El Salvador earlier this year, which US authorities later admitted was an mistake. After his repatriation to the United States to face alien smuggling charges, he was detained in federal custody.
In her order, the court pointed out that the authorities does not have a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
